Cancellation Policy
Effective date: 26 July 2026
This policy explains how cancellation requests for ELVARIS SOFTWARE LTD engagements are handled. It applies alongside the Terms & Conditions and any project-specific written proposal, which takes priority where the two differ.
How to request a cancellation
Cancellation requests can be submitted by telephone on +44 7737 137168 or by email to support@elvarissoftware.tech. We recommend following up a telephone request in writing so there is a clear record of the request and its date.
Cancellation before proposal acceptance
An enquiry or a proposal that has not yet been formally accepted in writing can be withdrawn at any time without cost, since no contract has yet been formed.
Cancellation after proposal acceptance, before work begins
Where a proposal has been accepted but work has not yet started, cancellation may still be requested. Any costs already committed on the client's behalf to third parties at that point (for example, pre-purchased licences requested by the client) are non-refundable and remain payable by the client.
Cancellation after work begins
Where work has already started, cancellation does not remove the obligation to pay for work carried out up to the date of cancellation, calculated by reference to the stage reached and the proportion of the agreed scope completed. Reserved project time already allocated in the delivery schedule may also be chargeable where it could not reasonably be reallocated.
Completed work
Fees for work stages already completed and accepted at the point of cancellation are not refunded. Where partially completed work exists but has not yet reached a review stage, ELVARIS will assess in good faith what proportion of the fee reasonably reflects the work carried out.
Reserved time
Where project delivery involves reserved calendar time (for example, a dedicated development or analysis window), cancellation with insufficient notice to reallocate that time may result in a charge reflecting the reserved period, as set out in the relevant proposal.
Committed third-party and non-refundable external costs
Where third-party costs (such as software licences, hosting or data purchased on the client's behalf) have already been committed or paid at the point of cancellation, and are non-refundable by the third party, these costs remain the client's responsibility.
Handover of completed material
Where a project is cancelled after some deliverables have been completed and paid for, ELVARIS will hand over the completed material relevant to the work paid for, subject to the intellectual property terms set out in the Terms & Conditions.
Outstanding invoices
Cancellation does not waive any invoices already due for work completed or costs committed prior to the cancellation date. Outstanding invoices remain payable in accordance with the agreed payment terms.
Written confirmation
ELVARIS will confirm the effective cancellation date, any final invoice amount and any handover arrangements in writing once a cancellation request has been processed.
Project-specific terms
Where a written proposal or project agreement sets out cancellation terms specific to that engagement, those terms take priority over this general policy.
Statutory rights
Nothing in this policy affects any statutory rights a client may have under applicable consumer protection law, where those rights apply to the engagement in question.
